These Terms & Conditions (“Terms”) govern your access to and use of MakaanSearch.in (“MakaanSearch”, “we”, “us”, “our”), including its website, property listings, property valuation services, buyer and seller assistance, Home Loan Guide, forms, reports, expert assistance and other services (“Services”).

By accessing or using MakaanSearch.in, submitting an enquiry, listing a property, requesting a valuation, contacting our experts or using any Service, you agree to these Terms. If you do not agree with these Terms, please do not use the Platform.

1. What MakaanSearch Does

MakaanSearch is a real-estate discovery and property assistance platform. Depending on the property, location and Service selected, MakaanSearch may help users:

• Discover properties for purchase
• List properties for sale
• Understand property information
• Obtain a Property Valuation Report
• Access available property-related reports and information
• Obtain guidance for first-time property purchases
• Understand home-loan options through the Home Loan Guide
• Connect with relevant experts
• Request site visits
• Receive assistance relating to property documentation or legal verification, where available

MakaanSearch may add, modify or discontinue Services, property categories or locations from time to time.

2. MakaanSearch Is Not Automatically the Seller or Owner

Unless specifically stated otherwise, MakaanSearch is not the owner, seller, developer, builder, buyer or lender of the property displayed on the Platform.

A property listed on MakaanSearch may belong to an individual owner or another authorized seller.

The actual sale or purchase of a property is between the relevant Buyer and Seller.

MakaanSearch facilitates property discovery, information, communication and selected supporting Services but does not automatically become a party to the underlying property transaction.

3. Properties Available on MakaanSearch

MakaanSearch may display the following categories, subject to availability:

• Commercial spaces
• Shops
• Offices

4. Property Information

Property listings may contain information such as:

• Property type
• Location
• Area
• Asking price
• Property photographs and videos
• Property description
• Seller information
• Ownership-related information
• Property valuation information
• Documentation information
• Loan-related information
• Property reports
• Site-visit information
• Other relevant property details

Information may be obtained from the Seller, documents provided by the Seller, MakaanSearch's own processes, site observations or other available sources. Information may change over time.

5. Property Verification

MakaanSearch may offer “Verified Property” listings where specified checks have been completed. The exact checks performed may differ depending on the property and Service.

Verification may include one or more checks relating to:

• Seller identity or contact details
• Property information
• Property location
• Documents provided
• Ownership-related information
• Physical or site information
• Other relevant information

What “Verified” Does Not Mean

A Verified Property does not automatically mean that MakaanSearch guarantees defect-free title, absence of every possible dispute, absence of undisclosed liabilities, future appreciation, guaranteed resale value, guaranteed investment return, guaranteed loan approval or a risk-free transaction.

The Buyer should conduct appropriate independent due diligence before purchasing a property.

6. Buyer Responsibilities

If you are considering purchasing a property through MakaanSearch, you are responsible for making your own final decision. Before completing a transaction, you should, where applicable:

• Verify ownership
• Review relevant property documents
• Check applicable permissions and approvals
• Verify property measurements
• Check applicable taxes and dues
• Check for relevant encumbrances
• Inspect the physical property
• Confirm the Seller's authority to sell
• Obtain professional legal advice where appropriate
• Confirm financing arrangements
• Confirm the final sale price and terms

MakaanSearch's information and Services are intended to assist your decision-making and do not replace independent due diligence.

7. Property Valuation Report

MakaanSearch may provide a Property Valuation Report to help users understand the estimated market value and relevant information relating to a property.

The report may consider property characteristics, location, market information, comparable information, available property data and other relevant factors used in the applicable valuation methodology.

The Property Valuation Report is intended as a decision-support tool. It does not guarantee the final sale price, the price a Seller will accept, the price a Buyer will pay, future appreciation, future resale value or investment returns.

Unless expressly stated otherwise, a MakaanSearch Property Valuation Report is not a statutory valuation, government valuation or guaranteed professional valuation for any particular legal or financial purpose.

The valuation may change if property information, market conditions or other relevant factors change.

8. Seller Property Listing

A Seller may submit a property to MakaanSearch for listing and sale assistance. The Seller may be required to provide property details, contact information, ownership-related information, photographs, property documents, expected price, location information and other information reasonably required for the listing or applicable Service.

MakaanSearch may review submitted information before publishing or continuing to display a listing.

9. Seller's Responsibility

By submitting a property, the Seller confirms that:

The information provided is accurate to the best of their knowledge.

They have the legal authority to market the property.

They have not knowingly provided false or misleading information.

Documents submitted are genuine and belong to the relevant property.

The property information will be updated if there is a material change.

They will inform MakaanSearch if the property is sold, withdrawn or otherwise unavailable.

The Seller remains responsible for the accuracy and legality of information submitted by them.

10. MakaanSearch Selling Assistance

Where available, MakaanSearch may assist Sellers through property information collection, property valuation, listing preparation, property presentation, buyer discovery, buyer enquiries, site-visit coordination, communication assistance and other agreed Services.

Listing a property does not automatically guarantee that the property will be sold.

11. 15-Day Selling Proposition

Where MakaanSearch promotes a 15-day selling target, the applicable property and Seller must meet the conditions communicated by MakaanSearch.

The ability to sell a property within a particular period depends on factors including property price, location, demand, property condition, documentation, Seller cooperation, buyer availability, negotiations, financing and market conditions.

Unless expressly stated in a separate written agreement, “15 days” represents a selling target and not an unconditional guarantee of sale.

Any specific guarantee, refund, fee arrangement or eligibility condition associated with a 15-day service shall be governed by separate written terms.

12. Removal of Property Listings

MakaanSearch may suspend, modify or remove a property listing if the property has been sold; the Seller requests removal; information appears inaccurate; required information or documents are not provided; the property appears unavailable; a listing violates these Terms; fraud or misrepresentation is suspected; the listing creates a legal, security or reputational risk; or MakaanSearch reasonably determines that removal is appropriate.

13. First-Time Buyer Guidance

MakaanSearch may provide additional information and assistance to users purchasing a property for the first time, including guidance relating to property discovery, evaluation, valuation, documentation, questions to ask before purchasing, site visits, financing and general buying processes.

First-Time Buyer guidance is intended to help users make better-informed decisions. It is not a substitute for independent legal, tax, financial, technical or professional advice.

14. Home Loan Guide

The MakaanSearch Home Loan Guide may help users understand different banks or lenders, available loan options, loan eligibility, down payment, EMI, interest rates, loan tenure, total repayment, relevant documentation and other home-loan considerations.

The Home Loan Guide is provided for information and decision-support purposes.

15. Home Loan Disclaimer

MakaanSearch does not guarantee loan approval, loan eligibility, loan sanction, a specific interest rate, a specific loan amount, a particular EMI, loan disbursement or approval by any particular bank or financial institution.

Final loan decisions are made by the relevant lender based on its own policies, eligibility criteria, documentation and assessment.

Information regarding banks, rates or loan products may change without notice.

16. Home Loan Enquiries & Consent

When a user requests home-loan assistance, the user may be contacted by MakaanSearch or relevant financial or lending partners for the purpose of responding to that request.

By submitting a home-loan enquiry, the user agrees to receive relevant communication through applicable channels, subject to applicable law. The user may withdraw marketing communication consent where applicable.

17. Property Documentation & Legal Assistance

Where MakaanSearch provides or facilitates documentation or legal verification assistance, the scope of such Service will depend on the Service selected and the information or documents provided.

Legal or documentation assistance does not automatically guarantee clear title in every respect, absence of undisclosed disputes, absence of future claims, approval by every authority or completion of every possible legal check.

Users may obtain independent legal advice before completing a property transaction.

18. Site Visits

Site visits may be arranged where available. A site visit is subject to availability and confirmation, does not reserve the property, does not constitute a purchase agreement, does not guarantee that the property will remain available and does not replace the Buyer's own inspection.

Users must follow reasonable safety and access requirements during a site visit.

19. Property Prices

Prices shown on MakaanSearch may represent a Seller's asking price, an indicative price, a negotiable price, an estimated value or other price information depending on the listing.

The displayed price may change. The final transaction price is determined by the Buyer and Seller.

Additional costs may apply, including applicable stamp duty, registration charges, taxes, transfer charges, government fees, maintenance or other property-related charges. Users should confirm all applicable costs before completing a transaction.

20. Property Availability

Property availability can change at any time. A property may be available, under discussion, under negotiation, sold, withdrawn or temporarily unavailable. MakaanSearch does not guarantee that a property will remain available after a user views or enquires about it.

21. Photographs & Property Media

Photographs, videos and other media are intended to represent the property. Media may have been supplied by the Seller, captured by MakaanSearch, edited or formatted for presentation, or taken at an earlier date. Users should inspect the actual property before making a final decision.

22. Third-Party Services

MakaanSearch may connect users with banks, financial institutions, legal professionals, documentation professionals, valuation or inspection professionals and other property-related service providers.

Third-party services may be subject to separate terms, fees and policies. MakaanSearch does not control the independent professional decisions of such third parties.

23. User Information

Users agree to provide accurate information when submitting buyer enquiries, seller listings, valuation requests, home-loan requests, site-visit requests, expert-contact requests or other forms. Users should update information if it becomes materially inaccurate.

24. Use of Submitted Property Content

When a Seller submits photographs, videos, descriptions or other property content, the Seller confirms that they have the right to provide that content.

The Seller permits MakaanSearch to use such content for property listing, property marketing, buyer discovery, website presentation, social media or advertising, and other legitimate Platform-related purposes.

25. Prohibited Activities

• Submitting fraudulent property information
• Uploading fake documents
• Misrepresenting ownership
• Impersonating another person
• Submitting a property without authority
• Misusing another user's personal information
• Scraping or copying MakaanSearch's property database
• Copying listings for commercial use
• Spamming users or Sellers
• Attempting to defraud another user
• Uploading unlawful or harmful content
• Interfering with Platform security
• Using the Platform for any unlawful purpose

26. Fraud & Payments

Users should exercise caution before making any payment relating to a property. Users must not request or share OTPs, banking passwords or card PINs in connection with ordinary MakaanSearch services, and should independently verify payment instructions and transaction documents before transferring money.

Suspected fraud or impersonation should be reported to MakaanSearch through its official contact channels.

27. Buyer–Seller Transactions

MakaanSearch facilitates property discovery and related assistance but does not automatically become a party to the transaction.

The Buyer and Seller are responsible for agreeing upon price, payment terms, sale agreement, possession, registration, taxes, charges and other transaction terms.

MakaanSearch is not responsible for disputes arising solely between the Buyer and Seller, except to the extent required by applicable law or a specific written Service agreement.

28. No Investment Guarantee

Information provided by MakaanSearch should not be interpreted as a guarantee that any property will appreciate, generate rental income, produce a particular return, become more valuable or be easier to resell. Property markets can change and past market performance does not guarantee future results.

29. Intellectual Property

The MakaanSearch name, logo, website design, original content, graphics, reports, interfaces and other proprietary materials are owned by or licensed to MakaanSearch. Users may not reproduce, modify, distribute, sell or commercially exploit such materials without prior written permission.

30. Privacy & Data

MakaanSearch may collect and process information required to provide its Services, including name, phone number, email, location, property preferences, property information, enquiry details, documents submitted for requested Services and website or device information.

The collection and use of personal information is governed by the MakaanSearch Privacy Policy.

31. Cookies

MakaanSearch may use cookies and similar technologies for website functionality, security, analytics, performance, personalization and marketing where applicable. Details should be provided in the MakaanSearch Cookie or Privacy Policy.

32. Platform Availability

MakaanSearch aims to keep the Platform available but does not guarantee uninterrupted access. The Platform may be temporarily unavailable due to maintenance, updates, technical issues, network failures, security issues, third-party service failures or events beyond reasonable control.

33. Information Accuracy

MakaanSearch makes reasonable efforts to provide useful and accurate information. However, information may originate from Sellers, third parties or external sources and may change. MakaanSearch does not guarantee that all information will always be complete, current, error-free or continuously available.

Users should verify material information before making a final transaction decision.

34. Limitation of Liability

To the extent permitted by applicable law, MakaanSearch shall not be responsible for losses arising from Seller-provided misinformation, Buyer/Seller disputes, property price changes, market changes, loan rejection, changes in interest rates, property defects outside the scope of a specific inspection, delays caused by third parties or transaction decisions made independently by users.

Nothing in these Terms excludes liability that cannot legally be excluded.

35. Indemnification

To the extent permitted by law, a user may be responsible for losses, claims or costs arising from false information submitted by the user, unauthorized property listings, fraudulent documents, misuse of the Platform, violation of these Terms, violation of third-party rights or unlawful activities.

36. Suspension or Termination

MakaanSearch may suspend or terminate access to the Platform or Services where a user violates these Terms, provides fraudulent information, misuses the Platform, attempts fraud, uploads fraudulent documents, abuses other users or employees, or creates a security or legal risk.

37. Changes to Services

MakaanSearch may modify, add, suspend or discontinue locations, property categories, reports, guides, features, expert services, home-loan partners or other Services.

38. Changes to Terms

MakaanSearch may update these Terms from time to time. The latest version will be published on MakaanSearch.in with the applicable effective date.

39. Governing Law

These Terms shall be governed by the applicable laws of India.

Jurisdiction: To be determined based on the registered office and legal advice applicable to the MakaanSearch operating entity.

By accessing MakaanSearch.in, submitting a form, listing a property, requesting a Service, contacting an expert or otherwise using the Platform, you acknowledge that you have read and agreed to these Terms & Conditions.
